Terms of Service
1. Agreement to these terms
These Terms of Service (the "Terms") form a binding agreement between you and AIKAN GLOBAL ENTERTAINMENT PTE. LTD. and govern your use of our websites and applications, including Aikan (the "Services"). By downloading, accessing or using the Services you agree to these Terms. If you do not agree, do not use the Services.
2. Eligibility
You must be at least 13 years old, or the higher minimum age required in your country, to use the Services. If you are below the age of majority where you live, you may use the Services only with the involvement of a parent or legal guardian who agrees to these Terms on your behalf.
3. Your account
Some features require an account. You agree to provide accurate information, to keep your credentials confidential, and to be responsible for all activity that takes place under your account. Tell us promptly at support@aikan-global.com if you believe your account has been used without your authorisation.
4. Licence to use the Services
Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable and revocable licence to use the Services for your own non-commercial entertainment. All rights not expressly granted are reserved.
You may not copy, record, download, screen-capture for redistribution, publicly perform, resell, sublicense, reverse engineer or create derivative works from any part of the Services or the content made available through them, except where such restriction is prohibited by law.
5. Purchases, coins and subscriptions
The Services may offer virtual coins, episode unlocks, one-off purchases and auto-renewing subscriptions. Prices are shown before you confirm a purchase and may vary by country and over time.
Purchases made through the Apple App Store or Google Play are processed by those stores and are also governed by their terms. Subscriptions renew automatically at the end of each billing period unless cancelled at least 24 hours before the renewal date, and cancellation is managed through your store account settings.
Virtual coins have no monetary value outside the Services, cannot be exchanged for cash and are non-transferable. Except where a refund is required by applicable consumer law or by the rules of the store that processed your payment, purchases are final.
6. Acceptable use
You agree not to use the Services to break the law; to infringe intellectual property or privacy rights; to upload or transmit malware; to probe, scan or circumvent security, geographic restrictions or content protection; to scrape or bulk-download content; to use automated means to create accounts or manipulate usage metrics; or to harass, threaten or abuse other users or our staff.
7. User content and feedback
If you submit comments, reviews or other material, you keep ownership of it and grant us a worldwide, royalty-free, non-exclusive licence to host, store, reproduce and display that material for the purpose of operating and promoting the Services. You confirm that you have the rights necessary to grant this licence.
Suggestions and feedback you send us may be used without restriction or compensation.
8. Intellectual property and copyright complaints
The Services, including all series, episodes, artwork, trademarks and software, are owned by the Company or its licensors and are protected by copyright and other laws.
If you believe that content available through the Services infringes your copyright, send a notice to dmca@aikan-global.com identifying the work, the material you say is infringing and where it can be found, your contact details, a statement made in good faith that the use is not authorised, and a statement that the information in your notice is accurate. We remove or disable infringing material and terminate the accounts of repeat infringers.
9. Third-party services
The Services rely on third parties such as app stores, payment processors, content delivery networks and advertising partners, and may link to third-party sites. We are not responsible for third-party services or content, and your use of them is governed by their own terms.
10. Disclaimers
The Services are provided "as is" and "as available". To the fullest extent permitted by law we disclaim all warranties, whether express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranty that the Services will be uninterrupted, secure or error-free. Content libraries change over time and specific titles may be added or removed without notice.
11. Limitation of liability
To the fullest extent permitted by law, neither the Company nor its officers, employees or suppliers will be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill, arising out of or relating to your use of the Services.
Our total aggregate liability for all claims relating to the Services is limited to the greater of the amount you paid us in the twelve months before the event giving rise to the claim, or fifty United States dollars. Nothing in these Terms limits liability that cannot be limited under applicable law, including liability for death or personal injury caused by negligence or for fraud.
12. Indemnification
You agree to indemnify and hold harmless the Company against claims, damages, liabilities and reasonable legal costs arising from your breach of these Terms, your misuse of the Services or your violation of the rights of a third party.
13. Suspension and termination
You may stop using the Services at any time and may ask us to close your account. We may suspend or terminate access if you breach these Terms, if required by law, or if we discontinue the Services. Provisions that by their nature should survive termination, including sections 7 to 14, will survive.
14. Governing law and disputes
These Terms are governed by the laws of the Republic of Singapore, without regard to conflict-of-law rules. Where you are a consumer, you keep the benefit of any mandatory protections of the law of your country of residence.
We would prefer to resolve any dispute informally. Please contact legal@aikan-global.com first so that we can try to reach a resolution before formal proceedings are commenced.
15. Changes to these Terms
We may revise these Terms as the Services evolve or as the law requires. We will update the effective date shown above, and for material changes we will provide reasonable notice. Continuing to use the Services after the changes take effect means you accept the revised Terms.
